Facts
An officer was conducting traffic enforcement in Havana, Florida when he observed a vehicle approach him at a high speed rate. The car passed him going 42 miles an hour in a 25 mile an hour speed zone when the officer turned his lights on in his marked patrol car and pulled the vehicle over to conduct a traffic stop. After him and one other officer approached the driver, the driver was in the car with our client who was sitting in the passenger seat. While the officers were speaking to the driver and the passenger, they began to smell a strong odor of marijuana coming from the vehicle. After officers smelled the marijuana, they searched the vehicle and one officer took control of our client’s purse. Our client was then placed under arrest after the officers retrieved a large amount of narcotics within her possession. She was filed charges with the following: Possession of Marijuana over 20g, Possession of Cocaine of 31g, possession of drug paraphernalia x3 (scale, grinder and pipe), possession of oxycodone (8pills) without prescription, possession of a concealed firearm with ammunition.
